Occupational Health & Safety (OHS) is focussed on the prevention and management of injury or ill health due to work, or the workplace.
OHS exists principally to prevent people from being harmed by their working environment (even if they are a guest just visiting a work site).
OHS legislation provides for statutory obligations that must be met, thereby ensuring that Directors, Managers and Supervisors are not open to litigation for OH&S or Environmental negligence.
There are two laws that govern occupational health & safety (OHS) in Australia. One law covers federal employees and there are separate laws for each State. Each jurisdiction passes its own different acts, regulations and codes of practice. These laws set out the minimum OH&S standards in Australia. These laws are designed to protect you in the workplace. Penalties for non-compliance with each OH&S Act are severe and also vary from state to state.
In each jurisdiction, a different regulatory body (e.g. WorkCover) is responsible to develop Regulations under the relevant OH&S Acts.
Regulations are designed to provide guidance on how to practically make your workplace safe. They cover requirements such as plant and environmental safety, employee amenities and consultation etc.
Penalties for non-compliance with these Regulations are less severe than a breach of the Act, but they may still carry a hefty fine. All of the Australian OH&S Acts cover both employers' and workers' behaviour and, it is now common for employees to be prosecuted when an incident occurs.
A WorkCover investigator would gather evidence of breaches of the Act or Regulations by any party involved in an incident. OH&S Acts are part of the criminal code. So a breach of the provisions of the Act is a criminal offence and those individuals successfully prosecuted carry a criminal record.
The extent of negligence is not an issue in criminal proceedings. So employers or workers who have breached the Act in either a major or minor way, face the same criminal liability.
